In Germany it's forbidden to do Nazi-Salute for humans is it the same for Garden Gnomes?

You could even say he's mocking the Nazi regime by portraiing them as gnomes

it seems the gnomes are treated differently.
All germans are equal but some german(gnomes) are more equal then others?
